CGU Insurance Limited v Porthouse [2008] HCA 30 – Claim made under a Barristers Civil Liability Professional Indemnity Policy. Indemnity under the policy was denied for failure by insured barrister to notify CGU of known circumstances.- Martin John Green in his capacity as liquidator of Arimco Mining Pty Limited (in Liquidation) v CGU Insurance Limited & Ors [2008] NSWSC 825 – Successfully defended CGU proceedings commenced by the liquidator of an insolvent mining company. Indemnity denied to director under directors and officers insurance policy for non-disclosure.
- Acting for mortgage managers against non-bank lenders for unconscionable conduct in contravention of the ASIC Act 2001 and Trade Practices Act 1974.
- Acting on behalf of structural engineers in relation to prosecution proceedings into the death of a young woman who sustained fatal crush injuries as a result of a 1.5 tonne sliding gate falling down.
- Acted on behalf of an English company in relation to the purchase of an aircraft from a French company involving issues of breach of contract, private international law, jurisdiction and applicable law.
- Acting for firm of engineers in relation to the design of the Great Western Highway.
- Acted for funds manager who specialises in Australian equities and large superannuation funds in a claim brought by client for breach of an Investment Management Agreement. Stocks held by client fell below the capitalisation benchmark and the fund manager failed to notify the client of the market change.
