This month we include a special report by Brendan Frawley of our Dublin Office summarising the key aspects of employment law in the Republic of Ireland, which we hope will be of interest to our clients with connections to the Emerald Isle.
In this edition we consider three Court of Appeal judgments concerning, respectively, whether an employer can be vicariously liable for the acts of its employees under the whistleblowing legislation, an employer’s ability unilaterally to withdraw notice of dismissal, and liability in the tort of negligence for unfair references. We also look at a recent Employment Appeal Tribunal judgment on whether employees on sick leave are entitled to be paid for untaken holiday. We then go on to review the government's recently announced proposals for what may prove to be the biggest shake-up of employment law for decades.
