Mortgage fraud

Kennedys' professional indemnity group has substantial expertise in the handling of claims against solicitors, surveyors, valuers and other property/financial consultants arising out of actual and potential frauds perpetrated during the years of the booming economy.

The recession has brought with it the exposure of those frauds and the group is handling a continually rising number of claims against the various professions and their insurers. The group also has considerable experience in advising on the insurance implications where fraud and dishonestly are suspected or alleged.

 

Our experience

Working within the group are lawyers who:

    • Experienced the mass lender litigation of the 1990’s arising out of a collapse in the property market.
    • Were involved in the managed cases which resulted in the leading authority of Bristol & West v Fancy & Jackson in 1995 which set the benchmark for these types of claims against the legal professional.
    • Defended substantial numbers of surveyors and valuers caught up in alleged mortgage frauds.
    • Were involved in defending claims in relation to the Harrovian Mortgage Fraud, the largest prosecution for mortgage fraud at this time.
